Patrol Contract Daily Worksheet
Writ Division
Deputies in the Writ Division work in a specialized area of responsibility within the Constable’s Office. Civil processes the deputies work on include:
  • Citations by Publications
  • Tax Warrant
  • Writs of Execution (Issued after final judgment from a court)
    • This requires the deputy to go make physical demand for the judgment amount from the defendant. If the defendant is unable to make payment, then the deputy MAY be required to seize non-exempt property and sell it to satisfy the judgment.
  • Writ of Attachment
    • An order to seize a defendant’s property in order to secure the claim of the plaintiff. 
  • Writ of Possession
    • A judgment that allows the Deputy to take possession of the premises in dispute, and return them to a landlord who prevailed in an eviction suit. 
  • Writ of Execution 
    • Issued by a court of competent jurisdiction, commanding a Deputy to levy upon the non-exempt property of a defendant, in satisfaction of a previous judgment rendered by the issuing court. 
  • Writ of Sequestration 
    • The temporary seizure or setting aside of specific property to which a party to a suit has a claim of ownership. The object is to allow parties to protect and preserve their property during the suit.
  • Orders of Sales (Tax and Property Sales)
    • The sales aspect of this department handles a variety of different tasks that allow the Deputy to sell, usually at public auctions, an assortment of real and personal property. Sales can range from tangible items such as land, homes, vehicles or other personal items to non-tangible items such as shares of a stock or interest in a company.

The Fort Bend County Precinct 3 Constable’s Office recognizes that law enforcement’s image and reputation depend on the personal integrity and discipline of all agency employees.  The Precinct 3 Constable’s Office pledges to competently and impartially investigate all allegations of misconduct by employees and complaints bearing on the department's response to community needs. 

 

Members of the public who are dissatisfied with how law enforcement service was provided, a failure to provide service, improper attitudes or behavior are encouraged to bring this to the attention of our office. Service-related complaints will be investigated, and proper corrective action will be taken as necessary.

Members of the public who have been victim of deputy misconduct or who have witnessed deputy misconduct are encouraged to report the misconduct to the Precinct 3 Constable’s Office.  Allegations of misconduct will be thoroughly investigated, and sustained allegations could result in additional training, counseling, reprimand, suspension, termination or, in the case of criminal allegations, referred to the criminal justice system.

A disagreement over the validity of a traffic citation is not a matter of misconduct. Such disagreements should be directed to the court that has jurisdiction in the matter.

Warrant Division

The Constable’s Office is the custodial agency for criminal warrants that are issued from the Justice Court. These warrants include, but are not limited to, the following:

  • Traffic Offenses
  • Issuance of Bad Checks (under $50)
  • Fail to Attend School / Truancy
  • Minor in Possession of Alcohol or Tobacco
  • Disorderly Conduct
  • Failure to Appear in Court
  • Theft by Check (over $50)
  • Class C Misdemeanor Charges

Our Warrant Division sends out a courtesy post-card to the address of the defendant who has an outstanding warrant which informs them of the situation and how to take care of the problem. If the deputies do not receive any feedback from the defendant within 1-2 weeks, then the warrants are entered into a statewide database that is accessible to law enforcement agencies. If the defendant has any interaction with the police, then they are subject to arrest.

In addition, our Warrant Division also has periodic “warrant roundups” whereas we deploy specialized units in a specified area, concentrating on arresting all persons in that area with outstanding warrants. This has been effective in past and future operations are pending.

The Justice Court has also had several “amnesty” periods in the past where people who have outstanding warrants for their arrest may come into the court, without the threat of being arrested, in order to handle their warrants. To apply for a reserve deputy position, complete the job application on the Jobs page and select Precinct 3 reserve deputy.

Steps in the process to become a reserve deputy are listed below:

  1. Complete the on-line application on the Jobs page.
  2. Once application received, you will be contacted for an interview.
  3. After the interview, a comprehensive background investigation will be conducted.
  4. If applicant passes the background check, the file is submitted to the Constable for approval.
  5. If approved, the applicant would have to submit to a drug test, physical, and mental fitness exam.
  6. Once tests are completed and passed, the applicant would have to secure a bond.
  7. The applicant is then commissioned by the agency as a deputy.

Our reserve deputies perform a wide variety of duties, including, but not limited to, bailiff for JP court, work in the Civil Division, assist with traffic complaints and at public relation functions and more.

Civil Division

Deputies in the Civil Division serve a wide variety of court documents issued by Justice, County, District Courts, as well as courts from out of state. These documents include, but are not limited to, the following:

  • Writs of Sequestration
  • Eviction Suits
  • Writs of Possession
  • Citations
  • Show Cause
  • Civil Subpoenas
  • Criminal Subpoenas
  • Criminal Summons
  • Retraining Orders
  • Protective Orders
  • Writs of Garnishment (seizing of money or financial instruments)

In addition to serving these different processes, deputies also perform duties as the Justice Court bailiff. They are required to keep the peace and maintain a presence at every session of court.

Deputies in the Civil Division serve more than 9,000 court documents each year.
