Attorney Fee/Expense Claim : Effective February 1, 2020

As of February 1, 2020, the County Court at Law Judges approved the use of a new Attorney Fee/Expense Claim Form for submission of court-ordered attorney fees and expenses for misdemeanor cases in the County Courts. This submission process will be accomplished by submitting the pdf-fillable form through eFile Texas. The Attorney Fee/Expense Claim Form along with instructions can be found at: Court Appointed Attorney's.

 

E-Filing Information

Per Texas Rules of Civil Procedure 21c(d) and Supreme Court Order Misc. Docket No 17-9039, Statewide Rules Governing Electronic Filing in Criminal Cases - Rule 4.4 the filer must notify the Clerk that your document must contain sensitive information. These documents will remain non-public.

As of February 15, 2024, the Fort Bend County Clerk will return all efiled documents containing unredacted sensitive information with the following notice:

Documents contain sensitive data. Please resubmit with all sensitive data redacted in accordance with the JCIT Rule 4.8.4. Please be advised, the STATE PROVIDED EFSP currently contains an auto redaction feature that provides both original and redacted versions upon acceptance. CRIMINAL E-FILING MANDATORY NOTICE

Pursuant to the Supreme Court Order - Misc. Docket No. 15-9205 [PDF], an order adopting statewide rules governing electronic filing in criminal cases has been adopted by the Fort Bend County Court at Law Courts, effective January 26, 2017.

**CRIMINAL RESET PROCEDURE**

FOR COUNTY COURT AT LAW NO. 1 ONLY

A blank reset form for criminal cases may be downloaded from the Court’s website under the Documents and Forms tab. The reset must be dated and signed by both the Attorney and Defendant (or with permission of the Defendant) and e-filed (with electronic notice to the Fort Bend County District Attorney’s Office) no later than 5:00 p.m. the day of the hearing/docket, but no earlier than seven (7) days prior to docket call. Failure to submit a reset timely may subject the Defendant to a bond forfeiture or a failure to appear. Regina Green, the Court Coordinator will have fourteen (14) days from the docket date to return a fully executed reset to all parties by email. The electronic reset ensures compliance with all Texas Supreme Court Emergency Orders and reduces the number of people within the courthouse. Criminal resets will NOT be accepted in the courtroom. The Court requires all business be conducted remotely, if possible. If you are unable to conduct business remotely, please contact the Court Coordinator for accommodations.

Please refrain from sending multiple emails to the Court Coordinator.  Resets will be processed on a first come first serves basis, and a signed copy will be emailed to you for your records.

Return For Correction

The County Clerk's Office makes every reasonable effort not to return filings. Many times a complimentary call will be made to the attorney in order to not return the filing. However, a call due to the volume of filings is not always possible. Please note some issues are with the eFile system; thus, not within the County Clerk's control. The County Clerk has modified the rule requirements regarding email address on specific documents submitted to our office for filing. See the E-Filing Information page for more information.

Copy Fees

  • Plain Copy $1.00 per page (paper or email)
  • Certified Copy (paper and electronic) $1.00 per page and $5.00 per document certification
  • Certificate of Authentication $5.00 per certificate
  • Vital record copy fees vary. See the Vitals Fee Schedule above for a list of fees.

When requesting NON-CERTIFIED, ELECTRONIC copies, please take into account the following fee:

Per Local Government Code Sec. 118.011 (a) (4) (C) – If you are requesting a NON-CERTIFIED, ELECTRONIC COPY of a document that was electronically recorded, is over 10 pages, and the document is not related to real property:

  • Starting with page 11, the fee for each page will be .10 cents for each page.
  • For example, a record which does not pertain to real property, that is 20 pages:
    • The first 10 pages are $1.00 per page.
    • From page 11-20, the fee will be .10 cents for each page.
    • Total is $11.00.

Certified Payments charges a convenience fee of $2.00 minimum when using a credit and debit card. 

Computer Information Fee Schedule

  •  CD-ROM/FTP of text and/or images of County Clerk's public information:
    • $20.00 per CD-ROM not to exceed 700 MB of data
    • $20.00 per monthly FTP up to 1 GB (or any portion thereof)
    • $15.00 per weekly FTP up to 1 GB (or any portion thereof)
    • $12.00 per bi-weekly FTP up to 1 GB (or any portion thereof)
    • $10.00 per daily FTP up to 1 GB (or any portion thereof)
    • $50.00 one-time set up fee for FTP customers at time FTP account is established 
  •  USB (County Clerk provides computer and customer provides USB hard drive)
    • $40.00 per daily export of data not to exceed 8 hours run time
