Court Rules
- Defendants must attend (in-person) all of their court settings.
- Reset Forms must have Defendant’s original signature. No exceptions.
- Motions for Continuance must be e-filed and ruled upon at least 1 week prior to a Jury Trial setting or a Bench Trial setting.
- No Pleas on the Jury Trial setting.
- Requests for Language Translators must be sent to the Court Coordinator at least 1 week prior the hearing or Trial.
- If a retained or appointed attorney cannot be present for a court setting, written notice must be sent to the Court Coordinator, Jackie Kermode, to request the AOD to assist their client with a reset. E-mail: Jackie.Kermode@fortbendcountytx.gov. Please give notice no less than 24 hours prior to the Docket.
Docket Days and Times
A Warrant will be issued if Defendant does not appear for their court settings.
Admonishment
Select Tuesdays at 11:00 a.m. These dates are scheduled by Allan Stoler, Senior Corrections Officer with the Fort Bend County CSCD.
Arraignment | Filed cases and Unfiled matters
Fridays at 8:30 a.m.
Misdemeanor criminal cases must be reset in person on the assigned court date. Defendants with no hired/retained counsel may complete an Affidavit of Financial Status and interview with an Indigent Defense Clerk to determine if he/she qualifies for a court appointed defense attorney. Unfiled matters are given a reset out to 2-3 months.
Bond Forfeiture Hold or Bond Forfeiture for Reinstatement
Tuesdays or Fridays at 9:15 a.m.
Contact the Court Coordinator to place a Defendant on this docket. Depending on the length of time Defendant was issued a Capias, Defendant may be directed to contact a bonding company, turn himself/herself into the Jail where a new Arraignment date will be assigned.
Discovery Motions with Witnesses
Select Tuesdays at 1:30 p.m.
Court Costs
Tuesdays or Fridays at 9:00 a.m.
If a Defendant owes Court Costs and/or Fines, he/she must be present on the assigned court date or a Warrant will be issued. If you paid and have a Zero balance before the court date, no need to appear.
Jail Docket
Wednesdays at 8:30 a.m.
The Jail Arraignment Docket is heard by Associate Judge Lewis White at the Fort Bend County Jail Courtroom. The deadline for attorneys to schedule an inmate on the docket is, without exception, 4:00 p.m. on the Monday preceding Wednesday’s docket. Jury Trial and Docket Call
Select Tuesdays at 1:00 p.m. The Jury Panel will be available at approx. 1:30 p.m.
Defendant and Counsel must be present for the 9:00 a.m. Docket Call the day of Trial.
No Pleas the day of Jury Trial.
A Pre-Trial Conference will also be set on select Tuesdays or Fridays at 10:00 a.m. Outstanding pre-trial issues may be heard at the Docket Call.
Motions/Early Terminations/Modifications/MRP/MAG/etc.
Tuesdays or Fridays at 10:00 a.m.
Requests for a court setting should be e-mailed to the Court Coordinator. The Texas Rules for proper service apply. All Motions for Early Termination must provide 2 weeks’ service/notice to the Probation Department and to the District Attorney’s Office.
Occupational or Restricted Licenses
Fridays at 9:00 a.m.
Applications are heard before Associate Judge Lewis White. To schedule a hearing, please contact his Court Coordinator, Eralyn Fisher at 281-341-4424 or preferably by e-mail at Eralyn.Fisher@fortbendcountytx.gov. The deadline to schedule a hearing is 3:00 p.m. on the Wednesday preceding the Friday docket. There are no exceptions to this deadline.
Plea Docket
Tuesdays or Fridays at 9:30 a.m. The Plea paperwork must be completed by 10:00 a.m.
No Pleas on the Jury Trial setting.
Requests for Language Translators must be sent to the Court Coordinator at least 1 week prior.
Reset/Non-Issue
Tuesdays at 9:00 a.m. After 3 Resets the case is set on the Status Docket.
Status Docket
Tuesdays or Fridays at 9:30 a.m.
Cases are set on this Docket after a designated number of resets on the Reset/Non-Issue Docket, before being placed on the Jury Trial Docket. These Defendants are completing classes or other requirements for dismissal; applying for pre-trial diversion programs; or reviewing offers from the ADA.
